Divorce

There are two basic parts to a divorce settlement: child custody and property division.  Oftentimes, alimony is an issue also.  At the Atlanta Family Lawyers, we understand even in the best circumstances, the emotions and stress associated with such a difficult event.  If you are contemplating divorce, we will give you good, sound advice. 

There must be a bona fide separation between husband and wife for a divorce to be filed.  As the state of Georgia is a no fault state for granting divorce, all issues with fault are allowable, which includes but not limited to:  child abuse, infidelity, and others.

All assets as well as debts accumulated during the marriage must be divided between the couple.  Property must be divided equitably. It doesn’t necessarily have to be 50/50, but that is a usual solution.

A parenting plan must be developed if children are involved.  Otherwise a judge will do it for you.  One parent will become the primary custodial parent.  Visitation is another issue that will have to be determined along with child support.
